Driver talking on a hands free cell phone not responsible for crash
In the recent decision of D'Amici v. Fahy, 2018 BCSC 1372 a determination of liability was made in an ICBC motor vehicle accident claim. The accident in Vancouver, B.C. At the time of the accident, the defendant driver was talking on a hands free cell phone. He was travelling north on Main Street at around 4:00 p.m. In the area where the accident occurred there are three northbound and three southbound lanes on Main Street.
