BC INTERIOR POKER CHAMPIONSHIPS

TOURNAMENT TERMS AND CONDITIONS (the “RULES”)

TOURNAMENT PERIOD

The BC Interior Poker Championships begins on Saturday January 5, 2019 and ends on Sunday March 24, 2019 (the “Tournament Period”). All daily qualification tournaments begin at 6:00 p.m. The Grand Championship begins at 5:00 p.m.

The qualification rounds for the BC Interior Poker Championships (the “Tournament”) begin on Saturday January 5, 2019 and ends on Saturday March 16, 2019. The qualification rounds of the tournament are held 6 days a week. The Grand Championships is held one day on Sunday March 24, 2019.

Dates, times and locations are subject to change, with notice to be sent via email if reasonably practicable.

TOURNAMENT FORMAT

The qualification round of the Tournament will take place over a ten-week period, five nights a week at the Tournament locations described above. Each night during the qualification round, a winner of the daily poker tournament will be announced. There will be up to 50 total winners from the 50 nights of the qualification round. Each of these winners will be given a ticket to enter the Grand Championships.

In addition, there will be up to 10 further winners who will be given a ticket to enter the Grand Championships, one winner for each of the ten weeks of the Tournament. All players who purchase $5.00 of food and drink at a qualification will be given a raffle ticket at the end of that qualification round. One raffle ticket is awarded for each full $5.00 increment purchased inclusive of tax but not gratuity. Players must stay to the end of the qualification round night and show their purchase receipt to obtain their raffle ticket(s).  At the end of each week, a raffle will occur and a winner will be chosen. The more food and drink the player purchases, the more raffle tickets the player can enter into the raffle. The raffles will be held every Saturday at Chances Casino. The winners will be notified by email.

Tickets are non-transferable. In the event an individual obtains more than one ticket to the Grand Championships he or she will also be awarded a special bonus prize valued at no less than $100 if that individual is declared the winner of the Grand Championships. The winner of the Grand Championships will win the Grand Prize

All persons with an entry ticket will face off in the Grand Championships held March 24, 2019 at Chances Casino beginning at 5:00 p.m.

ELIGIBILITY

Tournament is open to all legal residents of British Columbia who are nineteen (19) years or older. Tournament is NOT open to employees, officers and directors of Chances Casino, McCracken Pub, The Westsyder, and Hauer and Co. (“Excluded Participants”).

SPONSORS

This Tournament is being promoted and sponsored by Hauer and Co., 1201-B Summit Drive, Kamloops, B.C. (the “Sponsors”).

OPERATOR

The Tournament is operated by Fifth Street Poker.

HOW TO ENTER

No purchase necessary. There are two steps to enter

Step One:

  1. By completing a paper entry form at Hauer and Co. located at 1201-B Summit Drive, Kamloops, B.C., V2C 6C5. OR
  2. By completing an online entry form at www.BCInteriorPoker.com

The form will require your name, email address, telephone number and mailing address.

Step Two:

  1. By visiting  Hauer and Co. located at 1201-B Summit Drive, Kamloops, B.C., V2C 6C5 to pick up your tournament pass and welcome package.

At the tournament venue, you will show your tournament pass and be assigned a seat. Only those players holding a tournament pass will be allowed to play. If the player does not hold a tournament pass, he can register online at the venue and receive his welcome package. However, he can only play if there are seats available. Therefore it is best that all players come to each venue with a ticket available at 1201-B Summit Drive.

WELCOME PACKAGE

Your welcome package includes a T-shirt, a deck of poker cards, and a chocolate gift.

TOURNAMENT RULES

  1. Seats are limited. The first 50 players showing up with a ticket will be seated.
  2. The winner of each daily tournament will be automatically qualified for the Grand Championships held March 24, 2019.
  3. The poker is Texas Hold’Em.
  4. All players must abide by the table rules.
  5. All players agree that if awarded the Grand Prize that their name and photograph may be placed on Facebook, in the local newspaper, and social media sites.

GRAND PRIZE

There is one (1) Grand Prize available to be won in this Tournament (total approximate value $4,000). The Grand Prize is: an all-expense paid trip for two to Paris, France or the Mexican Riviera.

The trip includes a trip for 2 adults for a 5-7 day vacation to Paris, France or the Mexican Riviera.  The Grand Prize includes

  1. Round trip  economy  airfare from  Kamloops, B.C. to either Paris, France or the Mexican Riviera; and
  2. Joint occupancy 4-star hotel  room  for  5 –7 nights  subject  to availability

Prize is non-transferable, and travel must be completed by December 15,  2019.  One 5-7 day travel date will be chosen for the vacation.

ADDITIONAL EXPENSES

The following expenses/fees are the responsibility of the prize winner.

  1. travel insurance;
  2. food, beverages (may be included in an all inclusive Mexican vacation);
  3. taxi and transportation;
  4. personal expenditures; and
  5. all other expenses not specifically mentioned.

(“Additional Expenses”)

Upgrades may be available at an additional cost and can be arranged by prize  winner directly with Hauer and Co.

Prize holds a maximum retail value of $4,000.00 including taxes.

RULES ON THE GRAND PRIZE

Without limiting the generality of the foregoing, the following general conditions apply to the Prizes: (i) Prizes must be accepted as awarded and are not transferable, assignable or convertible to cash; (ii) Hauer and Co. reserves the right to substitute the Prize or a component thereof for any reason with a prize or a prize component of equal or greater value.

Any expenses incurred by the Prize winner (“Additional Expenses”) that are not expressly identified in the Tournament Rules as forming part of the Prize, are the sole responsibility of the Prize winner.

TROPHY AND PHOTOGRAPH

All winners of the Grand Championships will have their name etched on a large Grand Championships Trophy to be on display. Their photograph with the trophy will be taken and the photograph may be published.

 

GENERAL RULES

By entering the Tournament, all entrants agree to be bound by the rules of the Tournament. All decisions of the Tournament Administrator with respect to all aspects of this Tournament are final. All legal residents of British Columbia are eligible to win, providing they are over the age of majority at the time they register for the tournament and  have conformed with the Tournament rules and providing that they are not Excluded Participants. This Tournament shall be subject to and construed in accordance with the laws of British Columbia and the federal laws of Canada applicable therein.

At its sole discretion, the Sponsors and Fifth Street Poker reserve the right to modify these Tournament Rules and/or cancel, terminate, modify or suspend the Tournament with or without notice.

RELEASE

To claim their prize, potential winner(s) (and if applicable, any guest(s) of the winner(s)) may be required to execute a legal agreement and release (“Release”) that confirms his or her: (i) eligibility for the Tournament and compliance with these Tournament Rules; (ii) acceptance of the prize as offered; (iii) release of the Sponsors and each of their employees, directors, officers, suppliers, agents, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Tournament, participation in any Tournament-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iv) grant to the Sponsors of the unrestricted right to produce, reproduce, convert, publish, broadcast, communicate by telecommunication, exhibit, distribute, translate, adapt, and otherwise use or re-use his or her name, image, likeness, comments, voice and/or biography in any and all media now known or hereafter devised in connection with publicity related to the Tournament. The executed Release(s) must be returned within fourteen (14) business days of the date indicated on the accompanying letter of notification or verification as a winner, or the selected individual(s) may be disqualified and any rights he or she may have to the prize will be forfeited in the sole discretion of the Sponsors.

 

INDEMNIFICATION BY ENTRANT

By entering the Tournament, each entrant releases and holds Releasees harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from: (a) their participation in the Tournament or any Tournament-related activity; (b) the acceptance, use, or misuse of any Prize; or (c) any breach of the Tournament Rules. Each entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the entrant’s participation in the Tournament, without limitation.

LIMITATION OF LIABILITY

The Sponsors assume no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any Release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of any message or communication from the Sponsors. The Sponsors are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Tournament or by any technical or human error which may occur in the administration of the Tournament. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of messages or communications from the Sponsors. The Sponsors assume no responsibility or liability in the event that the Tournament cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsors, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Tournament and/or the Tournament Website or any other frustration of this Contract between the entrant and the Sponsors.

CONDUCT

By participating in a Tournament, each entrant agrees to be bound by the Tournament Rules. Entrants further agree to be bound by the decisions of the Sponsors, which shall be final and binding in all respects. The Sponsors reserve the right, in their sole discretion, to disqualify any entrant found to be: (a) violating the Tournament Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Tournament, the Tournament Website, or any related promotional website; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any the Sponsor’s property or service; and/or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person, and (e) engaging in cheating or attempting to cheat in the Tournament. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE TOURNAMENT WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION. If applicable, winners (and guests, if applicable) must at all times behave appropriately when taking part in the prize and observe the Tournament Rules and any other rules or regulations in force at any prize-related locations. The Sponsors reserve the right to remove from any prize-related locations, any winner(s) and/or guest(s) who break such rules and/or fails to behave appropriately and to disqualify such winner(s) and/or guest(s).

PRIVACY / USE OF PERSONAL INFORMATION

By registering for  the Tournament, each entrant: (i) grants to the Sponsors the right to use his/her personal information provided when he/she enters the Tournament (collectively the “Personal Information”) for the purpose of administering the Tournament, including but not limited to contacting and announcing the winner(s) and coordinating the provision of the Tournament prize; (ii) grants to the Sponsors the right to use his/her Personal Information for publicity and promotional purposes relating to the Tournament in any and all media without further compensation unless prohibited by law; (iii) acknowledges that the Sponsors may disclose his/her Personal Information to third-party agents and service providers of the Sponsors in connection with any of the activities listed in (i) and/or (ii) above, and (iv) grants the Sponsor the right to send communications via e-mail to the entrant about the activities and services provided by the Sponsor during and after the Tournament.  The entrant may choose to unsubscribe from emails at any time.

INTELLECTUAL PROPERTY

All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

TERMINATION

The Sponsors reserve the right, in their sole discretion, to terminate any Tournament, in whole or in part, and/or modify, amend or suspend a Tournament, and/or the Tournament Rules in any way, at any time, for any reason without prior notice.

 

LAW

These are the official Tournament Rules. The Tournaments are subject to applicable federal, provincial and municipal laws and regulations. The Tournament Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsors and/or the Tournaments. All issues and questions concerning the construction, validity, interpretation and enforceability of the Tournament Rules or the rights and obligations as between the entrant and the Sponsors in connection with the Tournaments shall be determined in British Columbia and governed by and construed in accordance with the laws of the province of British Columbia including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

DISCREPANCY

In the event of any discrepancy or inconsistency between the terms and conditions of the Tournament Rules and disclosures or other statements contained in any Tournament-related materials, including but not limited to the Tournament entry form, or point of sale, television, print or online advertising, the terms and conditions of the Tournament Rules shall prevail, govern and control.

SEVERABILITY

Each provision of this agreement shall be severable. If any provision of it is illegal or invalid, the illegality or invalidity shall not affect the validity of the remainder of this agreement.

NUMBER AND GENDER

This agreement is to be read with all changes in gender or number as required by the context.

INTERPRETATION

It is the desire of the parties hereto that this agreement be accorded a liberal interpretation consistent with its declared intent and purpose.

ENTIRE AGREEMENT

This agreement constitutes the entire agreement between the Partners and supersedes all prior and contemporaneous agreements, understandings and discussions, whether oral or written, and there are no warranties or representations between the parties except as expressly provided in this agreement.
